{"id":2226,"date":"2020-08-17T08:00:00","date_gmt":"2020-08-17T06:00:00","guid":{"rendered":"http:\/\/www.nimi.rs\/?p=2226"},"modified":"2023-12-11T09:47:38","modified_gmt":"2023-12-11T08:47:38","slug":"prava-i-obaveze-poslodavca-i-zaposlenog-u-vezi-sa-koriscenjem-godisnjeg-odmora","status":"publish","type":"post","link":"https:\/\/www.nimi.rs\/en\/prava-i-obaveze-poslodavca-i-zaposlenog-u-vezi-sa-koriscenjem-godisnjeg-odmora\/","title":{"rendered":"Prava i obaveze poslodavca i zaposlenog u vezi sa kori\u0161\u0107enjem godi\u0161njeg odmora"},"content":{"rendered":"<p>Propisi koji ure\u0111uju prava i obaveze poslodavca i zaposlenog u vezi sa kori\u0161\u0107enjem godi\u0161njeg odmora su:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"http:\/\/www.nimi.rs\/wp-content\/uploads\/2019\/12\/Zakon-o-radu.pdf\">Zakon o radu<\/a>,<\/li>\n\n\n\n<li>Posebni zakon kojim je ure\u0111ena odre\u0111ena oblast, odnosno delatnost,<\/li>\n\n\n\n<li>Posebni kolektivni ugovor za odre\u0111enu delatnost i<\/li>\n\n\n\n<li>Op\u0161ti akt poslodavca (kolektivni ugovor kod poslodavca ili pravilnik o radu), odnosno ugovor o radu za poslodavce koji nemaju op\u0161ti akt.<\/li>\n<\/ul>\n\n\n\n<p>Godi\u0161nji odmor treba da se koristi u teku\u0107oj godini za tu kalendarsku godinu. Ovo, na \u017ealost, nije uvek mogu\u0107e. Zbog toga je&nbsp;<a href=\"http:\/\/www.nimi.rs\/en\/\">Zakonom<\/a>&nbsp;dozvoljeno da se deo&nbsp;<strong>godi\u0161njeg odmora iz teku\u0107e godine mo\u017ee koristiti i u narednoj kalendarskoj godini. Rok za kori\u0161\u0107enje je najkasnije do 30. juna naredne godine. Postoje i slu\u010dajevi kada se i ceo godi\u0161nji odmor mo\u017ee prebaciti za narednu godinu.<\/strong><\/p>\n\n\n\n<p>Zaposlen, ince sti\u010de pravo na godi\u0161nji odmor posle mesec dana neprekidnog rada &nbsp;od&nbsp;poslodavca od dana zasnivanja radnog odnosa. Izmenom Zakona o radu, pre nekoliko godina, smenjen je uslov od 6 meseci za sticanje&nbsp;prava na godi\u0161nji odmor na 1 mesec.<\/p>\n\n\n\n<p>Zaposleni koji su po\u010deli da rade kod poslodavca u pro\u0161loj ili nekoj od prethodnih godina, sti\u010du pravo&nbsp;na godi\u0161nji odmor prvim danom nove godine, i mogu ga odmah koristiti (na primer u januaru). Zaposleni koji su po\u010deli da rade u teku\u0107oj godini, mogu da koriste godi\u0161nji odmor tek nakon isteka&nbsp;prvog meseca neprekidnog rada u firmi.<\/p>\n\n\n\n<p>Zaposleni ima pravo na minimum 20 dana odmora odnosno srazmeran broj dana za&nbsp;nepune godine rada. Du\u017eina godi\u0161njeg odmora utvr\u0111uje se Pravilnikom o radu koji donosi poslodavac. Va\u0161i&nbsp;zaposleni imaju pravo na minimum 20 dana godi\u0161njeg odmora, koji se garantuju Zakonom o radu. U&nbsp;Pravilniku o radu ovaj broj dana mo\u017ee se i pove\u0107ati po razli\u010ditim osnovama (du\u017eina radnog sta\u017ea kod&nbsp;poslodavca, doprinosi radu, \u010dinjenica da je zaposleni roditelj malog deteta itd.).&nbsp;Zaposleni za pune godine (u kojima se o\u010dekuje da \u0107e biti u radnom odnosu punih 12 meseci) imaju pravo&nbsp;na pun godi\u0161nji odmor (20+ radnih dana).<\/p>\n\n\n\n<p>Zaposleni koji u godini za koju se utvr\u0111uje godi\u0161nji odmor zapo\u010dinju ili prekidaju radni odnos imaju&nbsp;pravo na srazmeran deo godi\u0161njeg odmora.&nbsp;Srazmeran deo godi\u0161njeg odmora utvr\u0111uje se tako \u0161to se broj punih meseci rada do kraja godine (ili do&nbsp;dana isteka ugovora o radu ili prestanka radnog odnosa po drugom osnovu) mno\u017ei sa koeficijentom&nbsp;1,66666.<\/p>\n\n\n\n<p>Pri utvr\u0111ivanju du\u017eine godi\u0161njeg odmora, ra\u010duna se da radna nedelja ima 5 radnih dana. Ako va\u0161i&nbsp;zaposleni rade 6 dana nedeljno, za 5 dana godi\u0161njeg odmora bi\u0107e odsutni 7 kalendarskih dana (prakti\u010dno&nbsp;6 radnih dana ne rade na svakih 5 dana godi\u0161njeg odmora).<\/p>\n\n\n\n<p>Re\u0161enje iz aktuelnog Zakona o radu ne uzima u obzir rad kod prethodnih poslodavaca. Na du\u017einu&nbsp;godi\u0161njeg odmora koju ste du\u017eni da odobrite zaposlenom ne uti\u010de \u010dinjenica da je zaposleni pre vas radio&nbsp;kod drugog poslodavca ili bio nezaposlen, koristio odmor u prethodnoj firmi ili ne. Potvrda koju&nbsp;zaposleni donese od prethodnog poslodavca da nije koristio godi\u0161nji odmor u toj firmi za vas ne proizvodi&nbsp;nikakvo pravno dejstvo.<\/p>\n\n\n\n<p>U dane godi\u0161njeg odmora ne ura\u010dunavaju se dani praznika koji su neradni, pla\u0107eno&nbsp;odsustvo, bolovanje. Ako u vreme odmora padne neki od ovih dana, godi\u0161nji odmor se produ\u017eava.Tako da, ukoliko se desi da u godi\u0161nji odmor pada praznik koji je neradan dan, zaposlenom se&nbsp;produ\u017eava godi\u0161nji odmor za jedan dan. Ukoliko se zaposleni razboli i otvori bolovanje, godi\u0161nji odmor&nbsp;se prekida i nastavlja po zaklju\u010denju bolovanja.<\/p>\n\n\n\n<p>Odmor se mo\u017ee koristiti odjednom ili u delovima, pri \u010demu prvi deo mora da traje\u00a0najmanje 2 nedelje. Prvi deo godi\u0161njeg odmora mora da se koristi u trajanju od 10 radnih dana neprekidno\u00a0i to u teku\u0107oj godini, a preostali deo odnosno delove zaposleni mo\u017ee da iskoristi do 30 juna naredne\u00a0godine.<\/p>\n\n\n\n<p>Ako ne iskoristi prvi deo godi\u0161njeg odmora u teku\u0107oj godini, zaposleni gubi pravo na kori\u0161\u0107enje odmora&nbsp;u narednoj godini, izuzev, ako godi\u0161nji nije koristio jer je bio na bolovanju (zbog bolesti ili poro\u0111aja i nege&nbsp;deteta).<\/p>\n\n\n\n<p>Zaposlenom se moze isplatiti naknada za neiskori\u0161\u0107eni godi\u0161nji odmor samo u slucaju prestanka radnog odnosa, a kada zaposleni nije bio u\u00a0prilici da iskoristi godi\u0161nji odmor. U tom slu\u010daju zaposleni ima pravo na naknadu \u0161tete za neiskori\u0161\u0107eni godi\u0161nji odmor za ceo odmor ili deo\u00a0odmora koji nije iskoristio.\u00a0Naknada se ispla\u0107uje u visini prose\u010dne zarade za prethodnih 12 meseci, srazmerno broju dana\u00a0neiskori\u0161\u0107enog odmora.
