Izmenom Zakona o radu, pre nekoliko godina, smenjen je uslov od 6\nmeseci za sticanje&nbsp;prava na godi\u0161nji odmor na 1 mesec.<\/p>\n\n\n\n<p>Zaposleni\nkoji su po\u010deli da rade kod poslodavca u pro\u0161loj ili nekoj od prethodnih godina,\nsti\u010du pravo&nbsp;na godi\u0161nji odmor prvim danom nove godine, i mogu ga odmah\nkoristiti (na primer u januaru). Zaposleni koji su po\u010deli da rade u teku\u0107oj\ngodini, mogu da koriste godi\u0161nji odmor tek nakon isteka&nbsp;prvog meseca\nneprekidnog rada u firmi.<\/p>\n\n\n\n<p>Zaposleni\nima pravo na minimum 20 dana odmora odnosno srazmeran broj dana za&nbsp;nepune\ngodine rada. Du\u017eina godi\u0161njeg odmora utvr\u0111uje se Pravilnikom o radu koji donosi\nposlodavac. Va\u0161i&nbsp;zaposleni imaju pravo na minimum 20 dana godi\u0161njeg\nodmora, koji se garantuju Zakonom o radu. U&nbsp;Pravilniku o radu ovaj broj\ndana mo\u017ee se i pove\u0107ati po razli\u010ditim osnovama (du\u017eina radnog sta\u017ea kod&nbsp;poslodavca,\ndoprinosi radu, \u010dinjenica da je zaposleni roditelj malog deteta\nitd.).&nbsp;Zaposleni za pune godine (u kojima se o\u010dekuje da \u0107e biti u radnom\nodnosu punih 12 meseci) imaju pravo&nbsp;na pun godi\u0161nji odmor (20+ radnih\ndana).<\/p>\n\n\n\n<p>Zaposleni\nkoji u godini za koju se utvr\u0111uje godi\u0161nji odmor zapo\u010dinju ili prekidaju radni\nodnos imaju&nbsp;pravo na srazmeran deo godi\u0161njeg odmora.&nbsp;Srazmeran deo\ngodi\u0161njeg odmora utvr\u0111uje se tako \u0161to se broj punih meseci rada do kraja godine\n(ili do&nbsp;dana isteka ugovora o radu ili prestanka radnog odnosa po drugom\nosnovu) mno\u017ei sa koeficijentom&nbsp;1,66666.<\/p>\n\n\n\n<p>Pri\nutvr\u0111ivanju du\u017eine godi\u0161njeg odmora, ra\u010duna se da radna nedelja ima 5 radnih\ndana. Ako va\u0161i&nbsp;zaposleni rade 6 dana nedeljno, za 5 dana godi\u0161njeg odmora\nbi\u0107e odsutni 7 kalendarskih dana (prakti\u010dno&nbsp;6 radnih dana ne rade na\nsvakih 5 dana godi\u0161njeg odmora).<\/p>\n\n\n\n<p>Re\u0161enje\niz aktuelnog Zakona o radu ne uzima u obzir rad kod prethodnih poslodavaca. Na\ndu\u017einu&nbsp;godi\u0161njeg odmora koju ste du\u017eni da odobrite zaposlenom ne uti\u010de\n\u010dinjenica da je zaposleni pre vas radio&nbsp;kod drugog poslodavca ili bio\nnezaposlen, koristio odmor u prethodnoj firmi ili ne. Potvrda\nkoju&nbsp;zaposleni donese od prethodnog poslodavca da nije koristio godi\u0161nji\nodmor u toj firmi za vas ne proizvodi&nbsp;nikakvo pravno dejstvo.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Primeri:<\/h2>\n\n\n\n<p>Zaposleni\nje zasnovao radni odnos u 2017. godini i prijavljen je na neodre\u0111eno.<\/p>\n\n\n\n<p>U\nPravilniku o radu predvi\u0111eno je da godi\u0161nji odmor traje 20 dana i nisu\npredvi\u0111ena uve\u0107anja.<\/p>\n\n\n\n<p>Ovaj\nzaposleni ima pravo na 20 dana godi\u0161njeg odmora u 2018. godini.<\/p>\n\n\n\n<p><br>\nZaposleni je zasnovao radni odnos u 2017. godini na odre\u0111eno. Ugovor isti\u010de\n30.06.2018. godine.<\/p>\n\n\n\n<p>U\nPravilniku o radu predvi\u0111eno je da godi\u0161nji odmor traje 20 dana i nisu\npredvi\u0111ena uve\u0107anja.<\/p>\n\n\n\n<p>Zaposleni\nmo\u017ee da koristi godi\u0161nji odmor za 2018. godinu odmah na po\u010detku godine,\nsrazmerno broju&nbsp;meseci do isteka ugovora o radu, dakle pola godi\u0161njeg\nodmora, odnosno 10 radnih dana (6 meseci rada u&nbsp;2018 x 1,66666).<\/p>\n\n\n\n<p>Zaposleni\nje zasnovao radni odnos na odre\u0111eno u periodu od 20.03.2018. do 19.09.2018.<\/p>\n\n\n\n<p>U\nPravilniku o radu predvi\u0111eno je da godi\u0161nji odmor traje 20 dana i nisu\npredvi\u0111ena uve\u0107anja.<\/p>\n\n\n\n<p>Zaposleni\nmo\u017ee da koristi godi\u0161nji odmor za 2018. godinu od 20.04.2018. godine i to u\ntrajanju od 10&nbsp;radnih dana (6 meseci x 1,66666). Bez obzira \u0161to radi samo\nmesec dana, zaposleni ima pravo na ceo&nbsp;godi\u0161nji odmor (srazmerno broju\nmeseci do isteka ugovora o radu ili isteka godine, a ne do meseca&nbsp;u kojem\notpo\u010dinje kori\u0161\u0107enje godi\u0161njeg odmora).<\/p>\n\n\n\n<p>Ukoliko\nposlodavac i zaposleni produ\u017ee ugovor na odre\u0111eno nakon njegovog isteka, za jo\u0161\n6 meseci,&nbsp;zaposleni sti\u010de pravo na jo\u0161 5 radnih dana odmora (3 meseca x\n1,66666) dakle ukupno 15 radnih dana za 2018. godinu.<\/p>\n\n\n\n<p>U\ndane godi\u0161njeg odmora ne ura\u010dunavaju se dani praznika koji su neradni,\npla\u0107eno&nbsp;odsustvo, bolovanje. Ako u vreme odmora padne neki od ovih dana,\ngodi\u0161nji odmor se produ\u017eava.Tako da, ukoliko se desi\nda u godi\u0161nji odmor pada praznik koji je neradan dan, zaposlenom\nse&nbsp;produ\u017eava godi\u0161nji odmor za jedan dan. Ukoliko se zaposleni razboli i\notvori bolovanje, godi\u0161nji odmor&nbsp;se prekida i nastavlja po zaklju\u010denju\nbolovanja.<\/p>\n\n\n\n<p>Ukoliko\nse zaposlenom porodi supruga, odazove se na vojnu ve\u017ebu ili drugi poziv\ndr\u017eavnog organa, stupi&nbsp;u brak ili se desi neki drugi doga\u0111aj po kom ima\npravo na pla\u0107eno odsustvo, zaposleni mora da podnese&nbsp;zahtev poslodavcu za\npla\u0107eno odsustvo, a godi\u0161nji odmor onda mo\u017ee da se nastavi nakon&nbsp;okon\u010danja\npola\u0107enog odsustva ili da se iskoristi u budu\u0107nosti, kada delatnost poslodavca\ndozvoli. Dakle,&nbsp;godi\u0161nji odmor se ne produ\u017eava po automatizmu za dane\npla\u0107enog odsustva.<\/p>\n\n\n\n<p>Odmor\nse mo\u017ee koristiti odjednom ili u delovima, pri \u010demu prvi deo mora da\ntraje&nbsp;najmanje 2 nedelje. Prvi deo godi\u0161njeg odmora mora da se koristi u\ntrajanju od 10 radnih dana neprekidno&nbsp;i to u teku\u0107oj godini, a preostali\ndeo odnosno delove zaposleni mo\u017ee da iskoristi do 30 juna naredne&nbsp;godine.<\/p>\n\n\n\n<p>Ako\nne iskoristi prvi deo godi\u0161njeg odmora u teku\u0107oj godini, zaposleni gubi pravo\nna kori\u0161\u0107enje odmora&nbsp;u narednoj godini, izuzev, ako godi\u0161nji nije koristio\njer je bio na bolovanju (zbog bolesti ili poro\u0111aja i nege&nbsp;deteta).<\/p>\n\n\n\n<p>Zaposlenom se moze isplatiti naknada za\nneiskori\u0161\u0107eni godi\u0161nji odmor samo u slucaju prestanka\nradnog odnosa, a kada zaposleni nije bio u&nbsp;prilici da iskoristi godi\u0161nji\nodmor. U tom slu\u010daju zaposleni ima pravo na naknadu \u0161tete za neiskori\u0161\u0107eni\ngodi\u0161nji odmor za ceo odmor ili deo&nbsp;odmora koji nije\niskoristio.&nbsp;Naknada se ispla\u0107uje u visini prose\u010dne zarade za prethodnih 12\nmeseci, srazmerno broju dana&nbsp;neiskori\u0161\u0107enog odmora.
